Service Description
Arizona Pest Control provides residential and commercial pest management services throughout the state of Arizona. Our services include inspection, identification, treatment, and ongoing monitoring of common desert pests including scorpions, termites, rodents, cockroaches, ants, spiders, bed bugs, and other arthropods and wildlife native to or established in Arizona. Treatments may involve interior and exterior applications, baiting systems, exclusion techniques, trapping, and integrated pest management strategies tailored to local conditions. Service frequency is determined by pest pressure, property conditions, and the specific program selected. We deploy licensed technicians trained in Arizona-specific pest biology, pesticide application, and safety protocols. All services are performed during scheduled appointments, with access to the property required for completion. Emergency and callback services are available within our standard service areas but are subject to technician availability and weather conditions. We do not provide fumigation services, structural repairs, or landscape renovation as part of standard pest control packages.
No Guarantee or Warranty
Arizona Pest Control does not guarantee the complete or permanent elimination of pests from any property. Pest biology, environmental conditions, neighboring infestations, construction gaps, and client activities can all affect treatment efficacy and reinfestation rates. Results vary by property, season, and pest species. Desert pests in particular—including bark scorpions, roof rats, and certain ant species—exhibit resilient breeding patterns and may reestablish populations despite professional intervention. We do not warrant that our services will prevent property damage, health issues, or personal injury related to pest presence. Any written service agreements, retreatment provisions, or satisfaction commitments are limited to the specific terms contained in those individual contracts and do not extend beyond their explicit scope. No oral promises or representations supersede these terms. Client testimonials and marketing materials represent individual experiences and do not constitute guarantees of similar outcomes.
User Responsibilities
Clients must provide accurate property information, disclose known pest activity, and report prior treatments or chemical applications. Interior services require secure containment of pets, removal of food preparation items from treatment zones, and ensuring that children and sensitive individuals remain away from treated areas for the specified reentry period. Clients must maintain reasonable sanitation standards, eliminate standing water, seal accessible food sources, and implement recommended structural repairs or exclusion measures. Failure to follow preparation guidelines or post-treatment instructions may reduce efficacy and void any retreatment obligations. Clients are responsible for informing us of changes in property use, new construction, landscaping modifications, or health conditions that may affect service delivery. Access to locked gates, secured buildings, or restricted areas must be provided at scheduled times. Repeated missed appointments without adequate notice may result in service suspension or termination.
Limitation of Liability
To the maximum extent permitted by Arizona law, Arizona Pest Control shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to property damage, lost profits, emotional distress, allergic reactions, or secondary infestations. Our total cumulative liability for any claim shall not exceed the amount actually paid by the client for the specific service giving rise to the claim during the twelve months preceding the incident. We are not liable for damage to personal property, landscaping, or structures caused by preexisting conditions, client failure to disclose relevant information, or acts of third parties. This limitation applies regardless of the legal theory asserted, whether in contract, tort, negligence, strict liability, or otherwise. Clients assume the risk of inherent limitations in pest management science and the unpredictable behavior of living organisms.
Intellectual Property
All content on Arizona Pest Control websites, marketing materials, service documentation, proprietary treatment protocols, training materials, and business systems is the exclusive property of Arizona Pest Control or its licensors. This includes trademarks, service marks, logos, photographs of Arizona pest species, educational content about desert pest biology, and custom software used for scheduling and reporting. Clients receive no license to reproduce, distribute, modify, or create derivative works from any protected materials. Technician observations, treatment records, and photographic documentation generated during service remain our property, though clients may request copies of service reports pertaining to their account. Use of our name or likeness in testimonials or reviews is permitted only for non-commercial purposes and does not grant any intellectual property rights. Unauthorized use of our trademarks or misrepresentation of affiliation with our company is prohibited.
Governing Law
These Terms of Service and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any legal action or proceeding relating to our services must be brought exclusively in the state or federal courts located in Pima County or Maricopa County, Arizona, as appropriate based on venue rules. Clients consent to personal jurisdiction in these courts and waive any objection to venue or inconvenient forum. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If any provision of these terms is held invalid or unenforceable under Arizona law, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent.
Changes to Terms
Arizona Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Material changes will be posted on our website with an updated effective date. Continued use of our services after such changes constitutes acceptance of the revised terms. Clients are encouraged to review these terms periodically. For clients with ongoing service agreements, material changes affecting pricing, liability limitations, or dispute resolution procedures will be communicated at least thirty days before taking effect, unless required sooner by law or emergency circumstances. Historical versions of these terms may be requested by contacting our office. No waiver of any term shall be effective unless in writing signed by an authorized representative. Our failure to enforce any right or provision does not constitute a waiver of future enforcement.
